By accessing or using Gift Registry at giftgiving.fun ("the Service"), you agree to be bound by these Terms of Service. Please read them carefully before creating an account or using the Service.

1. About the Service

Gift Registry provides a universal gift registry platform that allows users to create wish lists, share them with friends and family, and coordinate gift-giving without revealing who is buying what. The Service is free to use for both registry owners and guests. We are supported by advertising (Google AdSense) and affiliate commissions (including the Amazon Associates programme).

You must be at least 13 years of age to create an account. By creating an account you represent that you meet this requirement.

You are responsible for maintaining the confidentiality of your account credentials (username, password, and any passkeys you register) and for all activity that occurs under your account. Please notify us immediately via our contact page or at admin@giftgiving.fun if you suspect unauthorised access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms, at our sole discretion and without prior notice.

You retain ownership of any content you submit to the Service, including gift names, descriptions, product links, registry names, and cover photos. By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to store, display, and transmit that content as necessary to operate the Service. You are solely responsible for the accuracy and legality of the content you post.

We reserve the right to remove any content that violates these Terms or that we reasonably believe could expose us or others to harm, without prior notice to you.

5. Gift claiming and purchases

Gift Registry is a coordination platform only. We do not process payments, handle physical goods, or take any part in the transaction between a gift-giver and a retailer. When a guest claims a gift and follows the product link to a retailer, any purchase they make is solely between them and that retailer. We make no warranty as to the availability, quality, or price of any product listed on the Service.

Claimed gifts that are not marked as purchased or received within 90 days are automatically released back to the available pool. This is to prevent gifts from being permanently locked by abandoned claims.

6. Affiliate links and advertising

Some gift links on this platform may be affiliate links. When you click through to a retailer and make a purchase, we may earn a commission at no additional cost to you. We participate in the Amazon Associates programme (Australia and United States) and may integrate with other affiliate networks over time.

The Service also displays advertisements provided by Google AdSense. Advertisements are served by Google and are subject to Google's advertising policies. We are not responsible for the content of third-party advertisements.

7. Intellectual property

All software, design, text, graphics, and other materials that comprise the Service (excluding user-submitted content) are owned by or licensed to us and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.

We do not guarantee that any gift links will remain valid or that product information (including prices) will be accurate or up to date.

To the fullest extent permitted by applicable law, Gift Registry and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service — including but not limited to loss of data, loss of revenue, or claims by third parties — even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount (if any) you have paid to us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Gift Registry and its operators from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

We may update these Terms from time to time. We will post the updated Terms on this page with a revised "Last updated" date. For material changes, we will endeavour to provide notice to registered users by email. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

13. Governing law

These Terms are governed by and construed in accordance with the laws of Australia, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.
